Eligibility: A 2024 Mt. Hood Territory Photo Contest (the “Contest”) is open only to those who are 18 years of age as of the date of entry. The Contest is only open to legal residents of The United States (excluding residents of Puerto Rico) and is void where prohibited by law. Employees of CLACKAMAS COUNTY TOURISM, dba OREGON’S MT. HOOD TERRITORY (the “Sponsor”) their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Contest.
Agreement to Rules: By participating, you agree to be fully, unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of the Sponsor, as final and binding as it relates to the content. Winning a prize is contingent upon fulfilling all requirements set forth herein.
Contest Period: Entries will be accepted online starting on or about June 4, 2024 12:00:01 AM PST and ending July 31, 2024 at 11:59:59 PM PST.
How to Enter: On or about June 4, 2024 the Sponsor will promote a Photo Contest using electronic and/or print marketing efforts. Participants will have the option to submit entries online at https://mthoodterritory.com/photo-contest where they will be given the option to complete an online entry form. Mandatory fields to be completed online include first and last name, email and phone number. By completing the online form for the Contest, the Participant agrees to receive promotional information from the Sponsor and its partners.
The entry must fulfill all Contest requirements, as specified, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of the Sponsor. You may enter only once and you must fill in the information requested. You may not enter more times than indicated by using multiple email addresses, identities or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of the Sponsor.
Upon receipt, entries become property of Sponsor.
Entrants agree that the Sponsor, its affiliates, directors, officers and agents are not liable for, and will be held harmless against, any and all claims to injury, loss or damage of any kind resulting directly or indirectly from participation in this contest or from acceptance or use of any prize.
Prize: One winner will choose a $50 e-gift certificate (the "Prize") to a local business from a curated list. The winning image will also be considered for publication in the 2024-25 Mt. Hood Territory Travel Planner. The specifics of the Prize shall be solely determined by the Sponsor. No cash or other prize substitution permitted except at Sponsor’s discretion. The Prize is non-transferable. Any and all Prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. No substitution of Prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted.
Odds: The odds of winning depend on the number of eligible entries received.
Winner selection and notification: One winner will be determined on or around the week of August 5, 2024 from all eligible entries. All decisions are final and binding. Odds of winning will be determined by the season the photo is taken in, photo composition, photo focus, and overall photo quality. Photos must be in the boundaries of Clackamas County. Winner will be notified on or around the time of the selection via email or phone. Winner will have seven (7) calendar days from email and/or phone notification to accept the prize. Sponsor is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify winner or for late, lost, misdirected, or unsuccessful efforts of winner to claim prize. If the selected winner cannot be contacted, is ineligible, or fails to claim a prize, prize may be forfeited or an alternate winner selected. An unclaimed prize will become the property of the Sponsor.
Rights Granted by you: By entering this contest you understand that the Sponsor, anyone acting on behalf of the Sponsor, or its respective licensees, successors and assignees will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and winner’s name, portrait, picture, voice, likeness, image or statements about the Contest, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.
Terms: The Sponsor reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Contest should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Contest. In such case, the Sponsor may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by the Sponsor. The Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or website or violates these Terms & Conditions. To receive the prize, the winner may be required to complete a 1099 form and submit it to the Sponsor.
Conditions: THIS CONTEST IS VOID OUTSIDE THE UNITED STATES, AND WHERE PROHIBITED. This Contest is subject to federal, state, and local laws and regulations, including tax laws. Certain restrictions may apply. Sponsor is not responsible for late, lost, stolen, mutilated, incomplete, illegible, misdirected, or postage-due mail. Entries void if the Sponsor determines the entry to not be an original, or if the entries are illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error or obtained through fraud or theft. Participants also agree to be bound by these Official Rules.
Release and limitations of liability: By participating in the Contest, Entrants agree to release and hold harmless the Sponsor, the administrator, their respective parents, officers, directors, employees, agents, subsidiaries, affiliates, distributors, sales representatives, advertising and promotional agencies (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Contest or receipt or use of the Prize, including, but not limited to: (a) any technical errors that may prevent an Entrant from submitting an entry; (b) unauthorized human intervention in the Contest; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Contest or the processing of entries; or (f) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Contest or receipt of any prize. Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries.
Released Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to Entrant's or any other person's computer relating to or resulting from participation in this Contest or downloading any materials in this Contest. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Contest, and in no event shall the Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
Disputes: Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Oregon. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Oregon, without giving effect to any choice of law or conflict of law rules (whether of the State of Oregon or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Oregon.
